Terms of Service

1. Acceptance of Terms
These Terms of Service constitute a legally binding agreement between you and MyZappz Loyalty Solutions Limited (“MyZappz”, “we”, “us”, or “our”). By downloading, registering, or using MyZappz, you agree to these Terms of Service. If you do not agree, do not use the platform.
2. User Accounts
You must provide accurate information when registering. You are responsible for maintaining the security of your account credentials. Notify us immediately at contact@myzappz.com if you suspect unauthorised access.
3. Vendor Responsibilities
- Vendors must honour loyalty offers they have set and published to customers
- Vendors must not award fraudulent stamps or manipulate the loyalty system
- Promotional shouts must be truthful and comply with applicable advertising laws
- Vendors are responsible for their own compliance with local business and tax regulations
4. Customer Responsibilities
- Customers must not attempt to duplicate, forge, or transfer QR codes fraudulently
- Customers must only share loyalty offers with other platform users where explicitly permitted by the vendor
5. Billing and Subscriptions
Paid vendor plans are billed monthly or yearly through Stripe. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are provided at our discretion and are not guaranteed for partial billing periods.
6. Prohibited Use
You must not use MyZappz to:
- Transmit spam, misleading, or illegal content
- Attempt to reverse-engineer, hack, or scrape the platform
- Impersonate another business or person
- Violate any applicable law or regulation
7. Termination
We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe are being used fraudulently. You may delete your account at any time from within the app.
8. Limitation of Liability
MyZappz is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
9. Changes to Terms
We may update these terms at any time. Continued use of the platform after changes are posted constitutes acceptance of the revised terms.
10. Governing Law
These Terms are governed by the laws of New Zealand. If you are using the platform in Australia, nothing in these Terms limits any rights you may have under the Australian Consumer Law.
